The client must be legal of age or received the permission from their legal guardian or parents who will do a contract in their stead. Their legal guardian or parent will be responsible for all of the transactions made.

The artist must always be credited as @nemayuu_

For Live2D vtuber projects the client must credit the artist on their bio/profiles/on a visible place.

We may adjust our pricing in the future.

We are not responsible for any misconception if the client does not read our TOS thoroughly.

We reserve the rights to refuse your request / order.

We will not make any extra parts that were not agreed upon in the initial commission agreement.

Any new parts or add-on added which were not agreed upon may be treated as a new commission.

The Model Art Commission includes our editing/fixing to support the rigger needs, until the model is done being rigged. If the client requests an extra part that needs to be drawn later on (e.g., more arms, more accessories), it will be treated as a new commission and extra charge will be applied accordingly.

We can give you updates on each stage of the project (after we start on your commission.)

We will be responding within 1 day or within few hours due to time zone differences. If we did not respond your message within 1 day please resend it. In case the message did not go through, or we may have not received it.

We will not work with any forms of AI generated images, designs or models generated with AI etc. We will reject all of this to begin with, but if any managed to get pass through, we reserve rights to terminate the commission without refunds.

You are purchasing a digital file, not a physical product.

The client is responsible for providing accurate and clear references. Extra fees will be charged if you decided to change your request midway.

Deadlines are negotiable to an extent. Rush fees will be applied. For each type of commission, the details and timeframe are listed in the description.

We greatly respect your designs. However, each artist has their own drawing styles. If our artist was unable to replicate the original art style, some parts might be adjusted to suit our art style. (E.g., color palettes.)

Our artist's art is constantly developing, you may see slight difference in our sample and the final product you will be receiving. This also includes the art tier and package the client chose to order.

Please be communicative. If the client is uncooperative, becomes unreachable (e.g., deleted social media, blocking us, ghosting, disappearing and not responding to our messages) we will consider the commission abandoned after 1-4 weeks (Time frame determined by the payment status and the project size).

We are unable to provide service for residents living in the EU and UK, due to VAT complexities.

For our artist's livelihood, we will prioritize paid commission first. For free projects (events, giveaways etc.) will be less prioritized but will keep you updated on our progress. Revision may or may not be given for free projects.

We do not allow any of our works to be used on AI image generators, NFT, or any crypto related field.

(Model Art) We do not allow additional outfits or extra changes to be added to the model by another artist.

The client or any 3rd party cannot edit or make changes to the commission, (unless it's a Live2D Model Art, only the rigger who rigs that certain commission can receive special permission.)

If the commission is a fanart, we retain the rights to use it for patreon/prints/artbooks etc.

We have the right to post the commission online. Unless there is debut date/reveal date, then we would wait accordingly with extra privacy price. If the client decides to drop/cancel/postpone their debut date/reveal date, we can discuss it. If the client is unreachable, unresponsive, postponing indefinitely, ghosting/blocking us. We hold full rights to post the commission online on the date agreed upon or within 3 months after the commission is finished or delivered.

We have the right to use the commissioned work as our portfolio/catalog and tutorial videos for educational purposes.

The client is not allowed to use the base body of the model art, or any part of our work to create new models. Especially when it's not redrawn by @nemayuu_ from Nebusphere Production.

You will own the copyright of the character design. The design and the character will belong to you.

When commissioning us for character design, the client only obtained rights to the final work when it has been fully paid, while all the drafts and sketches drawn throughout the commission belongs fully to the artist.

The client may only use the artwork within the scope of the license they have bought.

The client may not claim our artist's artwork as their own. Our artist keeps all ownership of the artwork commissioned.

The client or any 3rd party cannot edit or make changes to the commission.

Cannot be used for commercial usage.

For personal use, the artist's signature will be added to the work commissioned. Do not remove the artist's signature without the artist's permission.

You can use the illustrations for your profile picture (Personal Usage).

The commission cannot be printed, resold, redistributed, monetized in any way that could bring an income.

Only a single copy can be printed for personal use.

Commercial Rights are Digital Only License and cannot be used for physical products/merchandise unless the Extend Physical Product License is purchased separately.

Depending on the type of commission, extend digital commercial license may be included (e.g. Live2D Projects.)

The client is NOT ALLOWED to trace, distribute, or sale digital copies of our work. Especially on sites where people can download copies of our work. Such acts are strictly and extremely forbidden.

By commissioning outside of VGen, to join the waitlist there is a 10% reservation fee of the commission's price. The fees will be deducted from the total price. If cancel, the fees are non-refundable. The client can pay the rest/upfront payment (depending on the commission type) when it is their queue, and the artist is ready to start on their commission.

Payment Plans are only available for $400 and above Live2D Vtuber Projects .

Vtuber Model Art: 50% Upfront, Remaining 50% After the commission is done

All Art Commissions, Emotes, Illustrations, Vtuber Live2D Model Art and Rig are digital products only.

Payment can be made with Paypal, Wise Payment, and Stripe.

By choosing Paypal or Stripe, please commission me through VGen.

Invoice will be sent after confirming your request.

For payment plans, at least 50% of the payment must be paid upfront for us to start your commission. Otherwise, a full payment will be required.

For emotes and illustrations, the payment must be made in full. This is to prevent our artist's sketches/half-finished work from being thrown into AI generators.

Payment is due on receipt after we send you the invoice. Failure to make a payment within 48 hours will cause us to cancel your order. If you’re unable to make payment at that time, please contact us before we send you an invoice.

Another invoice will be sent for each payment.

If there is an additional charge, it will also be charged before the delivery.

If there is an extra revision fee, the revision fee must be paid in full upfront for the revision to be made. Revision fees are not included in the payment plan. The commission will be continued and finalized as is without revision if the revision fee has not been paid. Unless the client asked for the commission to be paused until they are ready to pay for the fee. The commission will be in the paused stage. Revision fee may change, or revision may not be possible depending on the stage of the commission.

With payment plans, if the client has any financial trouble and could not continue with the commission, we can negotiate to reschedule the commission at a later date. In this case, the commission will be paused, and no refunds will be given. The client will receive the files within the scope they paid for, (e.g., For Model Art, if the client only paid 50% upfront, they would receive the final draft they approved.) For Rigging, if the client only paid 50% upfront and did not continue, they may only receive the floating head tracking files etc. no project files will be given, only .moc3 files for motion tracking.

If the client cancels or does any chargebacks, they will not receive any files.

Please understand that any unfulfilled or incomplete payment will affect the project's delivery estimate date.

Once the commission is paused, if the client disappears or any continual non-communication problem occurs, the commission will be cancelled without refunds.

To resume the commission, the client may have to apply for a new slot. The artist's availability is not guaranteed.

Revisions are NOT available for Skeb-Style Surprise Commissions.

For other commissions: The WIP update of the sketches will be sent, you can request changes to the work in this stage. Revisions will be limited so please be clear and concise with your revisions.

Once the sketch is approved, revisions beyond sketch stage are free for minor changes (color changes etc.) Please keep in mind that the revisions are limited and extra revisions may cost a fee.

For rigging commission, all revisions are very limited and may cost a fee.

If the client fails to respond to feedback/revision requests within 2 days, our artist's reserve the right to continue with the project. Requests made after this will be counted as revisions.

The estimated time of arrival is written in the commission details. Please note that the estimated time should be used for reference and can be changed since each order is unique.

Once your order is finished and fully paid, it will be delivered through email or through DMs that has been agreed upon.

If the client chooses to pay with the payment plan, the delivery will be suspended until all the payments has been received.

The client must confirm the delivery within 48 hours. Please use this time period to check the artwork. Revision of small adjustments can be made once.

After 48 hours, the order will be considered completed. Any further requests will be charged a fee.

For rigging, we will only provide the .moc3 file and other necessary files where you can use your model on Vtube Studio and other tracking softwares. It will be delivered as ZIP format, you can unzip it. .cmo3 project source file will not be given.

NO Revisions/Adjustments are available for Skeb-Style Surprise Commissions.

Within 5 days (120 hour) of delivery, adjustments needed due to mistakes on our part such as missing parts or details will be corrected at no cost.

After delivery is completed, any request for revision will now be charged with a fee.

After delivery has been confirmed to be completed, due to the artist's availability and workload, the client may have to request a new order (slots not guaranteed.)

Under normal circumstances we do not offer any refund once we have started working on the project. If you think there is a possibility that you might need that money for any other reason, please do not commission us.

The client may cancel the commission with no charge if no payment has been made.

The client may request a refund, if the commission has not been started 3 months after paying.

If you did not respect our terms and violate them, we will have the right to revoke your rights to the work. No refunds will be given due to your violation.
